Terms and conditions

  1. Definitions 1.1 In these terms and conditions, the following definitions apply: a. Entrepreneur: Spicy Tile, part of GPV Concepts, located at Hogestraat 44, 7091 CE Dinxperlo, registered with the Chamber of Commerce under number 74861794, VAT number: NL860053593B01

  2. Applicability 3.1 These general terms and conditions apply to every offer made by the entrepreneur and to every distance contract concluded between the entrepreneur and the consumer. 3.2 Before the distance contract is concluded, the text of these general terms and conditions will be made available on the website in such a way that it can be easily stored on a durable data carrier.

  3. The Offer 4.1 If an offer has a limited validity period or is made under specific conditions, this will be explicitly stated. 4.2 The offer contains a complete and accurate description of the products offered. Obvious mistakes or errors do not bind the entrepreneur.

  4. The Agreement 5.1 The agreement is concluded at the moment the consumer accepts the offer and fulfills the stipulated conditions. 5.2 If the agreement is concluded electronically, the entrepreneur will immediately confirm receipt of the acceptance by electronic means.

  5. Right of Withdrawal 6.1 The consumer can dissolve an agreement regarding the purchase of a product during a cooling-off period of 14 days without giving any reasons. 6.2 The cooling-off period starts on the day after the consumer has received the product.

  6. Consumer's Obligations During the Cooling-off Period 7.1 During the cooling-off period, the consumer must handle the product and its packaging with care and only use the product to the extent necessary to ascertain its nature and characteristics.

  7. Exercise of the Right of Withdrawal by the Consumer and Costs Thereof 8.1 If the consumer exercises their right of withdrawal, they must notify the entrepreneur via email within the cooling-off period. 8.2 The consumer must return the product within 14 days after notification and bear the direct costs of returning it.

  8. Entrepreneur's Obligations Upon Withdrawal 9.1 The entrepreneur will refund all payments made by the consumer, including any delivery costs, within 14 days after being informed of the withdrawal.

  9. Exclusion of the Right of Withdrawal 10.1 The right of withdrawal is excluded for products manufactured according to the consumer's specifications (custom-made) or that have a clear personal character.

  10. The Price 11.1 The prices stated in the offer for products include VAT. 11.2 During the validity period stated in the offer, the prices of the offered products will not be increased, except for price changes due to changes in VAT rates.

  11. Conformity and Warranty 12.1 The entrepreneur guarantees that the products comply with the agreement and with the specifications stated in the offer.

  12. Delivery and Execution 13.1 The entrepreneur will exercise the greatest possible care in executing orders. 13.2 The place of delivery is the address that the consumer has made known to the entrepreneur. 13.3 The entrepreneur will execute accepted orders no later than 30 days, unless a longer delivery period has been agreed upon.

  13. Payment 14.1 Unless otherwise stipulated, the amounts owed by the consumer must be paid within 14 days after the start of the cooling-off period. 14.2 The consumer has the obligation to immediately report any inaccuracies in provided or stated payment details to the entrepreneur.

  14. Complaints Procedure 15.1 The entrepreneur has a sufficiently publicized complaints procedure and handles complaints in accordance with this procedure. 15.2 Complaints must be submitted to the entrepreneur fully and clearly described within a reasonable period.

  15. Liability 16.1 The entrepreneur is only liable for direct damage. Liability for indirect damage is excluded, unless there is intent or gross negligence.

  16. Force Majeure 17.1 The entrepreneur is not obliged to fulfill its obligations if it is prevented from doing so due to force majeure.

  17. Intellectual Property 18.1 All intellectual property rights to the products and the website belong to the entrepreneur. It is not permitted to reproduce materials without written permission.

  18. Personal Data 19.1 The entrepreneur processes personal data in accordance with applicable privacy legislation and as set out in the privacy statement.

  19. Applicable Law and Competent Court 20.1 These terms and conditions are exclusively governed by Dutch law. 20.2 Disputes will be submitted to the competent court in Amsterdam.

  20. Amendment of the Terms and Conditions 21.1 Changes to these terms and conditions will be published on the website in a timely manner. The amended terms and conditions will come into effect 30 days after publication.
